Preamble

The Sandpaper Accountability License aims to protect the Work created by pengu5055 and to ensure that it is used
in ways that reflect the principles of ethical behavior, social responsibility and human rights. While this 
license permits others to share, use and adapt the Work for non-commercial purposes it also establishes conditions
that aim to prevent harm and exploitation. The author firmly believes that creative works should be made available
for the public good and for the betterment of society. This license aims to create a balance between the free
sharing of knowledge and the responsibility that comes with it.

Terms and Conditions

THE WORK (AS DEFINED BELOW) IS LICENSED BY pengu5055 (the Author) UNDER THE CC BY-NC 4.0 INTERNATIONAL 
LICENSE, WITH THE ADDITIONAL CONDITIONS AS OUTLINED IN THE SANDPAPER ACCOUNTABILITY LICENSE, WHICH 
TAKE PRECEDENCE OVER THE GENERAL CC BY-NC 4.0 TERMS FOR THE FOLLOWING:

	a. ETHICAL USE - As outlined in Section 2 of this license the Work may only be used in ways 
	deemed ethical, lawful and non-harmful by the Author.

	b. USE IN AI - Use of the Work in the process of AI training is subject to additional restrictions
	and agreements as stated in Section 3 of this license.
	
	c. CEO ACCOUNTABILITY - The CEO of any Company wishing to use the Work must comply with the 
	disclosure and public statements as detailed in Section 4 of this license.

	d. SEVERABILITY - As I am not a lawyer, a severability clause is detailed in Section 5 of this 
	license.

1. DEFINITIONS
	
	a. The term "Author" refers to the individual who has created, compiled or contributed to the
	creation of the Work. In this case, pengu5055, the creator of the Work, holds all copyrights and
	intellectual property rights associated with it.

	b. "Licensee" refers to any individual or entity granted access to the Work under the terms of 
	this license.

	c. For the purposes of this license, the term "Work" refers to all the content hosted on this
	website or linked repositories owned by the author. This includes but is not limited to notebook
	scans, typed scripts, images, audio/video recordings, software code, and any other intellectual
	or creative works that may be made available.

	d. "Company" refers to any legal entity, organization or business, whether incorporated or not, 
	including but not limited to corporations, limited liability companies (LLCs), partnerships and 
	other similar organization. A company is considered a non-person in this license as it is a 
	legal entity distinct from a natural person.

	e. "CEO" refers to the CEO or highest-ranking official of a Company.

	f. "CC BY-NC" refers to the Creative Commons Attribution-NonCommercial License, which permits the
        Licensee to modify and build upon the Work non-commercially, so long as they credit the Author.

	g. "Shii" refers to the metaphorical expression of one's most valued assets. This includes but is 
	not limited to an object of personal or corporate significance (eg., Company logo, CEO's desk).

2. ETHICAL USE

	The Work, as defined above is licensed under the condition that it is used solely for constructive,
	lawful and ethical purposes. Any use of the Work that:

		a. Results in harm to individuals,
		b. Promotes violence, war, or discrimination,
		c. Violates human rights,
		d. Supports unethical uses in AI training (included but not limited to models that
		perpetuate harm, discrimination or bias and training that infringes on copyright)
	
	is strictly prohibited. The Author reserves the right to determine, at their discretion, whether any 
	use of the Work violates these principles.

3. USE IN AI

Use of the Work for AI training is strictly prohibited unless the CEO personally submits a formal request to 
the author and fulfils the terms as specified in Section 4 of this license. 

4. CEO ACCOUNTABILITY

If, at any time, the Work is used in a manner that violates the ways deemed ethical, lawful and non-harmful as 
specified in Section 2 of this license, the CEO must issue a formal public statement that:
	
	a. Acknowledges the unethical use of the Work,
	b. Clearly states the Company's intent to engage in harmful activity (et., promoting war, violence, or
	or unethical AI),
	c. Is distributed on the Company's official website and in two major news outlets (at least one of which
	must be a reputable international media source).

In addition to this, the CEO must submit a video:

	a. Of themselves stroking their shii with sandpaper in public (in a highly visible public
	settings, such as a park, plaza or city street),
	b. Addressing and specifying the harm they caused with the unethical use of the Work.

The video must be live-streamed and then posted to the Company's official website for perpetual public access.
Failure of the CEO or company to issue this statement within 10 business days after the misuse of the Work will in
result in:
	
	a. Immediate revocation of this license,
	b. Financial penalties for the misuse of the Work,
	c. Compensation for damages resulting from the unethical use of the Work.

5. SEVERABILITY

If any provision of this license is fount to be unenforceable, the remaining provisions shall remain in full effect.
